Litigation Deposition and Trial Testimony Experience
Pursuant to Federal Rules of Civil Procedure, Rule 26, (2), (B)
Testimony as a Police Officer:
1965 -1980 served as Deputy Sheriff, Sheriff's Sergeant, Sheriff's Detective and Sheriffs Lieutenant. Testified in criminal and civil cases as an officer, investigator, and police supervisor/mid-manager.
- I testified in criminal cases of arrests that I made or participated in.
- Court testimony for traffic violations from parking to vehicular manslaugther.
- Administrative law hearings and depositions concerning employee misconduct, discipline, hiring and termination.
- Expert testimony on prisoner transportation procedures, "weapons and tools" found in jail and prisoner searches, conditions of confinement and compliance to court rules and orders.
1970-1979 frequent judicial research reports, fairness hearings, responses to discovery motions, complaint investigation, and court appearances concerning jail and court security operations regarding Angela Davis, "San Quentin Six", Ruchel McGee & other related criminal and civil trials held in the Marin County Courthouse while Jail Commander, Comprehensive Employment and Training Act (CETA) Pub.L. 93-203 Manager for Sheriff's Department, and Court Security Lieutenant.
1980-1984, Sonoma County Sheriff's Corrections Division Captain prepared and supervised employment, civil and criminal cases for county, brought legal actions of Sheriff against employees and unions, testified in civil and criminal cases arising from Sonoma County and City Jail operations.
Cherco, et. al. v. County of Sonoma, 1980-84
Federal §1983 Class Action on Totality of Conditions. Sheriff's Representative in Settlement Team, personally wrote first federal "Litigation Reduction Grant" through National Institute of Corrections and helped create the concept of "Court's Monitor" to replace "Court Master" approaches. Case closed in 1992 with construction of new facilities. 22 Depositions over 3 years for jail related cases.
Branson, et. al. v. County of Santa Clara, 1984 to 1986 Main Jail Facilities in San Jose. State Court §1983 Class Action on Totality of Conditions. Court's Expert and Auditor on Inmate Classification, Segregation Unit Operations, Inmate Grievance Systems, and Inmate Discipline Procedures.
Fisher v. County of Santa Clara, United States District Court, San Francisco, 1985 Federal §1983 Class Action on Totality of Conditions for county Women's Facility. Court's Expert on Inmate Classification & Inmate Discipline.
